Warrant of Authority to Distrain

A warrant to distrain allows our bailiff to attend your commercial property to serve notice on the tenant, sieze the goods and chattels to cover the rent arrears and costs.

The bailiff will make an inventory of the goods to be removed. We then give you the choice on whether or not you want to enter into an arrangement to give the tenant further time to pay, then a walking possession notice will need to be signed by the tenant.

A walking possession will allow the tenant a little more time to pay the arrears but our bailiff will keep legal possession of the seized goods.

During this period of walking possession the goods would normally remain on the premises.

If payment is not received within the given time period, we will remove them to sell at public auction.

Warrant of Authority to Forfeit

Bailiwick Bailiff Services Ltd also undertakes the peaceful repossession of commercial premises, terminating the lease and handing the property back to the landlord.

Bailiwick Bailiff Services Ltd will ensure that the lease is forfeited by peaceful entry to the premises, changing the locks and denying the tenant entry into the premises. Notices will be displayed at all entry points.

A termination of the lease does not allow the landlord to retain any of the tenant's goods and chattels. However, in some cases this remedy can be effective to recover rents; the landlord may reinstate the lease at his/her discretion.
